Kansas lawmakers respond to agreement on Rattlesnake Creek water issues

Today, Kansas representatives Ron Estes and Tracey Mann, along with Senators Jerry Moran and Roger Marshall, addressed a recent agreement concerning the water needs in the Rattlesnake Creek Watershed. The U.S. Fish and Wildlife Service (FWS) announced its decision to conditionally pause its request to secure senior water rights in 2024. This pause is contingent on the Kansas Department of Agriculture-Division of Water Resources and local stakeholders finding a practical solution to current water impairments.

"Families, small businesses and communities in rural Kansas depend on the reliable source of water that comes from the Rattlesnake Creek Watershed," stated Rep. Estes. He expressed concern over potential disruptions by federal authorities but welcomed FWS's decision to halt its "water rights grab." Estes emphasized the need for collaborative efforts between FWS and Kansas stakeholders to ensure long-term water access.

Earlier this year, Rep. Estes met with FWS Director Martha Williams to advocate for Kansans' water access needs. He has also collaborated with state leaders and local residents to find solutions that do not adversely affect Kansans.

Senator Moran appreciated FWS's willingness to consider Kansans' concerns regarding the watershed. "It is important we establish long-term solutions that support the refuge and the regional economy," he said, noting his satisfaction with ongoing cooperative efforts toward sustainability.

Senator Marshall highlighted his personal connection as a property owner along Rattlesnake Creek for three decades. He stressed the importance of protecting agricultural communities amid drought conditions and praised federal partners for their commitment to conservation practices without imposing strict water curtailments.

Rep. Mann emphasized local knowledge in decision-making about water rights and regulation: "When it comes to decisions regarding water rights and regulation, landowners and local stakeholders know best." He welcomed FWS's acknowledgment of locally led solutions that avoid hindering agricultural producers and economies.
